Terms of Use

1. Agreement and eligibility

These Terms of Use ("Terms") govern your use of the StepRally mobile application, website, and related services (collectively, the "Service"). You must be at least 13 years old to use StepRally. If you have not reached the age of majority where you live, a parent or legal guardian must review and agree to these Terms for you.

2. Your account

You agree to provide accurate information, keep your login credentials secure, and notify us if you suspect unauthorized access. You are responsible for activity through your account. Usernames must not impersonate another person, violate another person's rights, or be abusive or misleading.

3. StepRally features

StepRally lets users sync step totals, set goals, connect with friends, and create or join private step challenges called rallies. Rally codes and invitations should be shared only with intended participants. Features, availability, calculations, and limits may change as we improve the Service.

Step totals and rankings may be delayed, incomplete, or affected by device settings, permissions, connectivity, Apple Health, or other technical factors. Rally results are intended for friendly recreation and are not independently verified.

4. Health and safety

StepRally is a general fitness and social challenge service. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Consult a qualified healthcare professional before beginning or changing an exercise program, especially if you have a medical condition or health concern. Stop activity and seek appropriate care if you experience pain, dizziness, shortness of breath, or other concerning symptoms.

You are responsible for exercising safely, following local rules, remaining aware of your surroundings, and choosing goals appropriate for you. Never use StepRally in a way that distracts you while driving or creates a risk of injury.

5. Community safety and acceptable use

StepRally has zero tolerance for objectionable content and abusive users. These rules apply to profiles, rally names and descriptions, and other content or interactions, including private and Community rallies.

You may not:

• Harass, threaten, deceive, stalk, intimidate, or harm another person.
• Share unlawful, infringing, hateful, discriminatory, sexually exploitative, abusive, or otherwise objectionable content.
• Manipulate step data, rally results, accounts, or Service functionality.
• Attempt unauthorized access, interfere with security, introduce malware, scrape the Service, or reverse engineer it except where law expressly permits.
• Use the Service for commercial gambling, unlawful contests, or illegal activity.
• Violate another person's privacy, intellectual property, or other rights.
• Knowingly submit false reports or use reporting tools to harass others.

Reporting content or users

Use Report or Report User where available in Friends or rally participant controls, or open Report a Problem in the app. Describe what happened and identify the user or content involved. You may also contact support@steprallyapp.com.

Blocking users

Use Block where available in Friends or rally participant controls. Blocking restricts applicable friend requests, boosts, and invitations. It does not automatically remove either person from an existing shared rally.

Moderation and enforcement

Reports are submitted to StepRally for review. We may investigate violations, remove violating content, and restrict, suspend, or terminate accounts for objectionable content, abusive conduct, or other violations of these Terms.

Reporting and blocking do not replace contacting local emergency services when someone is in immediate danger.

6. Your content

You retain ownership of content and profile information you submit. You grant StepRally a nonexclusive, worldwide, royalty-free license to host, process, reproduce, and display that content only as needed to provide, secure, and improve the Service. This license ends when the content is deleted from active systems, except where retention is technically or legally necessary.

You represent that you have the necessary rights to anything you submit and that it does not violate these Terms or applicable law.

7. StepRally's rights

The Service, including its software, design, branding, and original content, is owned by StepRally or its licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, personal, nonexclusive, nontransferable, revocable right to use the Service for its intended purpose.

8. Third-party services

The Service relies on third-party services, including Apple HealthKit and cloud infrastructure providers. Their services may be governed by separate terms and privacy policies. StepRally is not responsible for third-party services outside our control.

9. Suspension, termination, and deletion

You may stop using StepRally at any time and may delete your account in the app under Profile → Delete Account. We may suspend or terminate access if you violate these Terms, create risk or legal exposure, or misuse the Service. Provisions that by their nature should survive termination will remain in effect.

10. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available." We disclaim warranties of merchantability, fitness for a particular purpose, noninfringement, and uninterrupted or error-free operation. We do not guarantee the accuracy of step data, rankings, availability, or results. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, StepRally and its operators, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, goodwill, profits, or opportunities arising from the Service. Our total liability for claims relating to the Service will not exceed the greater of the amount you paid StepRally in the 12 months before the claim or US $100. These limits do not apply where prohibited by law.

12. Governing law and disputes

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Any dispute not resolved informally will be brought in a state or federal court with jurisdiction in New Jersey, unless applicable consumer law requires otherwise. Before filing a claim, please contact us and allow 30 days to try to resolve the issue informally.

13. Changes to the Service or Terms

We may modify or discontinue features and may update these Terms. We will post revised Terms here and update the effective date. If a change is material, we may provide additional notice. Continued use after the updated Terms take effect means you accept them.

14. General terms

If part of these Terms is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent. These Terms and the Privacy Policy constitute the entire agreement regarding the Service.
